Business litigation filed against DJ Garrix by Spinnin’ Records

Readers in Arizona who follow the music business may be familiar with DJ Garrix. The DJ, whose real name is Martijn Garritsen, is said to have abruptly terminated his contract with Spinnin’ Records, which sparked negotiations to settle their disputes. Even though some agreements were reached, the record company says it will still be filing business litigation against Garritsen for breach of contract.
According to the record label, it and Music All-Stars (MAS) management are due monies from Garritsen that have not been paid. The contract the company has with Garritsen is said to have provided that his management by MAS would be through July 1, 2017. Spinnin’ Records would also have exclusive rights to exploit and release Garritsen’s tracks through that date as well. Therefore, the company claims that it will lose income it is due under the contract since Garritsen’s alleged breach.
Spinnin’ Records claims to only want the monies it is due, nothing more. It even attempted to renegotiate its contract with Garritsen when he terminated the contract, but the parties could not agree on new terms. This was due, at least in part, to the fact that Garritsen contends that he was misled by the record label when he originally signed the contract and accuses the company of fraud. The company claims to understand that Garritsen wants to leave the label, but it contends that does not release him from his obligations under the existing contract.
As many Arizona business owners know, the company has a point. Unless the DJ can prove to the court that Spinnin’ Records committed fraud — which might render the contract null and void — or otherwise breached the agreement, he may be liable under its provisions. If business litigation is filed, each party will need to provide the court evidence that of the other party’s wrongdoing under the contract before the court will be able to make a decision.
